Why consider an alternative to the traditional life annuity?
Life annuities (occupied or unoccupied) rely on a risk factor: the seller's lifespan. But this model isn't suitable for all situations. Some people want a more predictable, flexible, or tax-efficient solution.
This is where alternative forms come into play, each with their own specificities.
Bare ownership: selling... without leaving your home
The sale of bare ownership is based on the principle of dismemberment of ownership.
The seller transfers bare ownership of their property, but retains the usufruct, i.e., the right to use and collect rent (if they rent it out).
They can therefore continue to live in their property, or rent it out if they are not currently occupying it.
In return, they receive a cash lump sum, with no annuity payments.
For the seller:
They remain in their home or continue to collect rent.
They receive a substantial sum upon closing.
They benefit from favorable tax treatment (no capital gains tax if it is the primary residence).
For the buyer:
They become the bare owner of the property.
They do not have to manage tenants or heavy expenses.
Upon expiration of the usufruct (death or early departure), they recover full ownership at no additional cost.
This is a widely used solution for transfer or long-term investment purposes.
Deferred Sale: A Risk-Free Alternative
In deferred sale, the principle is simple: the seller receives a down payment + monthly payments, but for a pre-determined period (e.g., 10 or 15 years).
Once the term has expired, the property is fully paid for.
Unlike a life annuity, the contract is not random: the duration and amount are known from the outset.
Two main types:
Free deferred sale: the buyer can occupy or rent the property immediately.
Occupied deferred sale: the seller retains use for a few years (a period specified in the deed).
For the seller:
They know exactly how much they will receive,
They can remain in the property for an agreed period,
They avoid the uncertainties associated with its longevity. For the buyer:
They benefit from a gradual payment without bank interest,
They invest without the uncertainties of a life annuity,
They can occupy the property quickly (open sale) or in the future (occupied sale).
Ideal for young retirees, those too young for a life annuity, or those looking for a more "classic" alternative without going through a bank.
